COLORADO COURTS AND FEE INFORMATION

The Colorado Courts are divided into Small Claims Court, County Court and District Court. Attorneys cannot practice or appear in Small Claims Court.

Most of our Retail Collection litigation occurs in County Court where the maximum amount in controversy is $15,000.00. The "Amount in Controversy" means where the debt claimed does not exceed $15,000.00 as of the date of filing the case.

The District Court may accept cases with any amount in controversy. There is neither a minimum nor a maximum.

The following are the various costs associated with filing a case in either District or County Court.

DISTRICT COURT MANDATED FEES

If your case is over the amount of $15,000.00 your case will be filed in District Court.

Mandatory Fees Applied in District Court Are As Follows:

• Filing a new case in District Court - INITIAL FILING
- o $224.00 Court fee
- o $6.00 Lexis Nexis transaction fee
- o $6.00 Lexis Nexis transaction fee for filing any additional documents in District Court after your case has been initially filed.
• Filing a Bank or Wage garnishment
- o $45.00 Court fee, per garnishment filed
- o $6.00 fee for the Lexis Nexis transaction if it is a District case only.
• Filing a Transcript of Judgment
- o $25.00 - $30.00 this charge will vary depending on the county it is filed in.
- o $6.00 fee for the Lexis Nexis transaction if it is a District court case only.
• E-Service charge through Lexis Nexis
- o $13.50 Lexis Nexis service charge - Court Mandated
• Filing a Foreign Judgment
- o $166.00 statutory filing fee
- o $6.00 fee for the Lexis Nexis transaction if it is a District case only.

COUNTY COURT MANDATED FEES

If your case is under the amount of $15,000.00 your case will be filed in COUNTY COURT.

Mandatory Fees Applied in County Court Are As Follows:

• Filing a new case in County Court - Initial Filing
- o $97.00 Court fee
- o $6.85 Lexis Nexis transaction fee
• Filing a Bank or Wage garnishment
- o $45.00 Court fee, per garnishment filed
• Filing a Transcript of Judgment
- o $25.00 - $30.00 this charge will vary depending on the county it is filed in.
• E-Service charge through Lexis Nexis - Court Mandated
- o $13.50 Lexis Nexis service charge
• Filing a Foreign Judgment
- o $166.00 statutory filing fee
• Filing additional documents through Lexis Nexis
- o There is no charge for filing additional documents in County Court.

PROCESS SERVERS

At Silverman/Borenstein, we take pride in the work we send out with our process servers. They go through an extensive screening process when they are hired. Our process servers are hired as independent contractors and are not employed by Silverman/Borenstein.

We use multiple servers and we monitor and track their proficiency with the legal documents that are sent out with them. Our process servers are prompt with returns of service and serving all legal documents.

Our Process Serving Fees Are As Follows:

- • $19.00 - $100.00 this cost will vary from the papers that are served and the counties they are served in.
